Welcome to My Books! These Terms of Use (“Terms”) govern your access to and use of the My Books mobile application (“App”). By using the App, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the App.
1. Eligibility
The App is available to individuals of all ages. However, users under 13 years old should use the App under the supervision of a parent or guardian. By using the App, you affirm that you meet these eligibility requirements.
2. User Accounts and Data
• Account Creation: You may be required to create an account using your Apple ID for select features. No account data is stored by us.
• Data Storage: Your data, including book covers and reading statistics, is stored through Apple’s iCloud services. We do not have access to your raw data, and it remains under your control.
• Data Deletion: You can delete your data at any time within the app settings. Once deleted, your data cannot be recovered.
3. Subscriptions and Payments
• Premium Features: Some features of the App are available through paid subscription known as the “Founding Member”. There are two variations, mostly and yearly, both containing the same benefits. All subscriptions and payments are handled through Apple’s in-app purchase system.
• Subscription Management: You can manage or cancel your subscriptions through your Apple ID account settings. Refunds are governed by Apple’s refund policy.
4. Content Ownership and Usage
• User Content: By using the App, you grant us a non-exclusive, royalty-free license to use your in app data and content solely for the purpose of providing the App’s services.
• Content Guidelines: You agree not to upload content that is unlawful, harmful, or infringes on the rights of others. We reserve the right to remove any content that violates these Terms.
5. Privacy and Data Collection
• Privacy: We value your privacy. Our use of your data is limited to what is necessary to provide and improve the App’s features. We only collect anonymous, non-identifying usage statistics for the purpose of understanding frequently used features and addressing bugs.
• Data Security: We utilize Apple’s secure infrastructure, including iCloud and CloudKit, to store and manage your data.
6. Prohibited Uses
You agree not to:
• Use the App for any illegal or unauthorized purpose.
• Access or attempt to access the App by any means other than the interface provided.
• Disrupt or interfere with the security, integrity, or performance of the App.
7. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including for any violation of these Terms.
8. Disclaimer of Warranties
The App is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the fullest extent permitted by law, My Books shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the App.
10. Changes to the Terms
We may update these Terms from time to time. If we make changes, we will notify you by revising the “Effective Date” at the top of the Terms. Your continued use of the App after the changes have been posted will constitute your acceptance of the new Terms.
